2. It is of particular importance to us to protect and securely store all personal data that you entrust to us. This document provides further information on how we use and process your personal data.

3. Purpose limitation, legal basis, storage period and data recipients
1. We require the collected personal data for order processing, invoicing, enforcement of contractual claims, customer service, and advertising purposes. The data is collected, stored, processed, and used for these purposes.

2. The legal basis for processing your personal data is, on the one hand, the performance of a contract (e.g., online purchase), legitimate interests, and the fulfillment of our legal and contractual obligations, and on the other hand, your consent (e.g., contact form, newsletter, cookies). Failure to provide the data may have various consequences.

3. We process your personal data [name, address, email address, etc.], as necessary, for the duration of the entire business relationship (from the initiation and processing to the termination of a contract) and beyond, in accordance with the statutory retention and documentation obligations arising, among other things, from the Austrian Commercial Code (UGB) and the Austrian Federal Fiscal Code (BAO), as well as until the conclusion of any legal dispute, ongoing warranty and guarantee periods, etc.

4. Newsletter
1. You can subscribe to our newsletter on the website using the double opt-in process. After subscribing, you will receive an email asking you to confirm your subscription. Without this confirmation, we cannot send you our newsletter. You can unsubscribe from the newsletter by clicking the unsubscribe link at the bottom of each newsletter.

2. Data processing is carried out on the basis of the legal provisions of Section 96 Paragraph 3 TKG and Article 6 Paragraph 1 Letter a (Consent) GDPR.

5. Online shopping
1. Please note that for the purpose of simplifying the purchasing process and for subsequent contract processing, the webshop operator Shopify stores the IP address of the internet connection owner, as well as the buyer's name, address, and credit card number, using cookies. Furthermore, we also store the following data for the purpose of contract processing: name, address, and email address.
The data you provide is necessary for the performance of the contract or for carrying out pre-contractual measures. Without this data, we cannot conclude the contract with you.

2. Your data will be transferred to Shopify for the purpose of processing your payment, to the transport/shipping company we have commissioned for the purpose of delivering the goods, and to our tax advisor for the purpose of fulfilling our tax obligations. These parties have committed to complying with applicable data protection regulations. A data processing agreement in accordance with Article 28 of the GDPR has been concluded. 3. Data processing is carried out on the basis of the legal provisions of Section 96 Paragraph 3 TKG and Article 6 GDPR (in particular consent and/or necessity for the performance of the contract).

6. Cookies, other tracking tools and web analytics

1. Cookies, other tracking technologies, and web analytics services may be used on our website in various ways. Cookies are small text files that allow us to recognize users and analyze their use of our websites. The information generated by these cookies is transmitted to and stored on the provider's server. This information helps us make our website more user-friendly, effective, and secure. Cookies are also used to measure page views and for general navigation.

5. Data processing is carried out on the basis of the legal provisions of Section 96 Paragraph 3 of the German Telecommunications Act (TKG) and Article 6 of the GDPR (in particular, consent). Since the privacy of our users is important to us, user data is pseudonymized.

7. Consent and right of withdrawal
1. If your consent is required for the processing of your data, we will only process it after receiving your explicit consent.

2. We do not process data of minors and are not authorized to do so. By giving your consent, you confirm that you are at least 14 years old or that you have the consent of your legal guardian.

3. You can withdraw your consent at any time by sending an email to info@proplanche.com. In such a case, the data previously stored about you will be anonymized and subsequently used only for statistical purposes without reference to any individual. Withdrawing your consent does not affect the lawfulness of the processing carried out based on your consent before its withdrawal.

8. Data security
1. pro planche GesbR employs technical and organizational security measures to protect stored personal data against accidental or intentional manipulation, loss, or destruction, and against access by unauthorized persons. Our security measures are continuously improved in line with technological advancements.

9. Your rights
1. You have the right to information about your personal data at any time. Unless there is a legal obligation to retain the data, you have the right to have this data erased and to object to its processing. Furthermore, you have the right to rectification of the data, to restriction of processing, to data portability, and to lodge a complaint with the Austrian Data Protection Authority (Wickenburggasse 8-10, 1080 Vienna, email: dsb@dsb.gv.at).
